Although Louis Vuitton has had numerous successes in protecting its intellectual property rights, it’s not always the case!🛡️💡

Louis Vuitton was unsuccessful in a dispute before the EUIPO where it attempted to block the registration of a trade mark consisting of the two letters ‘NL’, together with the words ‘LOVES VITTORIO’.🧑🏻‍⚖️👨🏽‍⚖️👩🏼‍⚖️⚔️™️

In the course of proceedings, the Opposition Division acknowledged that the marks bore little resemblance to each other. Consequently, the use of similar styling in the presence of different elements of the signs alone is not sufficient to mislead the relevant public.🏢™️

While Louis Vuitton had invoked the reputation of its mark, it did not provide any evidence in these proceedings to prove this.🔎🚫

As a consequence of the rejection of the opposition, the trade mark NL LOVES VITTORIO was registered. Louis Vuitton, still disagreeing with this ruling, filed an application for cancellation of this trade mark in 2022.
