A few weeks ago, KFC initiated legal proceedings against Church’s Texas Chicken, accusing its competitor of infringing the trademark ‘Original Recipe’, which KFC has been using since 1972.
KFC claims that the competitor’s use of the phrase ‘Original Recipe’ in its marketing campaign is likely to mislead customers and thus undermine KFC’s brand value.
According to KFC, the disputed trademark is a secret blend of 11 herbs and spices and has been part of the company’s branding for years.
Consequently, KFC is seeking monetary damages and a court injunction to stop the use of the disputed phrase in Church’s Texas Chicken advertisements.
