A Protracted Legal Battle: Hermes vs Buti

In order to protect its position in the market, the Hermes fashion house sometimes needs to engage in numerous legal disputes. 😓

One of them was the case against Buti di Buti Amerigo & C s.a.s. & Co. (Buti) attempting to market copies of the well-known Hermès handbags, i.e. Kelly and Birkin bags registered as three-dimensional trademarks. 🛍️

The dispute, after more than a decade, was settled by the Italian Supreme Court on 22 September 2022, which annulled the decisions of the lower courts and referred it back to the Court of Appeal for reconsideration, while indicating that the registered marks enjoy a presumption of distinctiveness. ⚖️

After various passages between the courts and a decisive stop at the Court of Appeal of Florence, justice reaffirmed the validity of the Hermès trademarks, precluding third parties from the unauthorized production of these models and condemning Buti to pay 500 euros for each replica sold. 💶

This ruling is a win in favour of Hermès also providing protection against the spread of unauthorised copies of Kelly and Birkin handbags from the Hermès fashion house on the market! 🎉

Per proteggere la sua posizione nel mercato, la casa di moda Hermes a volte deve impegnarsi in numerose dispute legali. 😓

Uno di questi era il caso contro Buti di Buti Amerigo & C s.a.s. & Co. (Buti) che tentava di commercializzare copie delle note borse Hermes, cioè le borse Kelly e Birkin registrate come marchi tridimensionali. 🛍️

La controversia, dopo più di un decennio, è stata risolta dalla Corte Suprema Italiana il 22 settembre 2022, che ha annullato le decisioni dei tribunali inferiori e l’ha rimandata alla Corte d’Appello per la riesame, indicando che i marchi registrati godono di una presunzione di distintività. ⚖️

Dopo vari passaggi tra i tribunali e una fermata decisiva presso la Corte d’Appello di Firenze, la giustizia ha riaffermato la validità dei marchi Hermes, precludendo a terzi la produzione non autorizzata di questi modelli e condannando Buti a pagare 500 euro per ogni replica venduta. 💶
