Our story begins with AUDI , a division of volkswagen , and a dispute with an online Polish retailer that was selling spare radiator grilles for older Audi models. These grilles had a carved out space designed to accommodate Audi’s iconic four-ring logo. 🏎️💨

Audi contested this design, arguing that it infringed upon their trademark rights™️.

The case was brought before a court in Warsaw, which then referred it to the EU’s Court of Justice for clarification. 🏛️🇪🇺

The EU court ruled in favor of Audi. They stated that the use of a shape similar to Audi’s logo, without its consent, was liable to infringe trademark law. They reasoned that the shape is visible to the public wishing to purchase such a spare part, which could constitute a material link between the spare part in question and the proprietor of the AUDI trademark.🛡️🔏
