The Delhi High Court has issued an important ruling in the trademark and domain name dispute between Tesla Inc. and the Indian company Tesla Power India Private Limited.

Tesla Inc. sought protection for its trademarks, including “TESLA POWER” and “TESLA POWER USA,” arguing that their use by the Indian company could mislead customers due to the recognition and prior registrations of the TESLA brand worldwide, including in India.

After analyzing the positions of both parties, the court found that the marks in question are identical, relate to the same category of products, and are targeted at the same customers and distributed through the same sales channels. In the court’s opinion, these arguments were sufficient to grant Tesla Inc. temporary protection in the form of an interim injunction at this stage of the proceedings.

In practice, this means that until a final judgment is issued, Tesla Power India Private Limited may not manufacture, sell, or promote electric vehicles under the “TESLA POWER” or “TESLA POWER USA” designations or use the indicated logo.
